: : I too got stung on the J.C. Whitney/DMK "smartperks" and "budgetsaver" scams, which offered me $100 discount from J.C. Whitney for "reviewing" a discount program. I never gave them my credit card # and did not agree to purchase anything, only to review the info. for 30 days. I've never received anything, but 30 days after I got that phone call a $124 charge appreared on my credit card.

: : First, I called our credit card company and filed a dispute for ALL the charges. Second, I called the number for DMK on my credit card statement and demanded a total refund. Third, I complained to J.C. Whitney for releasing our name & credit card # to Damark/Provell. (J.C. Whitney says they've received numerous calls from others also stung, so if you haven’t already done so, call them. They assured me that I would get a complete refund and promised to remove my name from their list and Damark’s list)

: : Damark/Provell eventually refunded $94 but insists that the $29.99 is non-refundable, but agreed to send me a form to request a refund. If you receive that form from Damark , BEWARE. The way the form reads is that you agreed to the non-refundable purchase but want a refund anyway. J.C. Whitney advised me to cross that statment off the form before returning it. The form also has a line for your signature, but the letter only asks for your name and address. I gave my name and address but did not sign the form because I don't want Damrak/Provell to have my signature as well as my credit card number. Just to be sure, I contacted my cred card company requested a new credit card number as old one had been used fraudulently.

: : Lastly, Damark will try again. I got another call this morning offering me $100 discount from J.C. Whitney. Needless to say, he never got any further before I went ballistic and advised him that he was working for a crook. Poor guy, but I felt much better!

: : The Attorney General's office in Minnesota is familiar with Damark/Provell and advised that complaints against the company be sent to Minnesota's Depart. of Consumer Affair.

: : I’d love to be part of any class action against them.

: : Good luck!

: I too a involved in this scam. Just like the other guy I agreed to look at something for no charge and determine whether I liked it. The plan came from Speigel through Damark-Provell. I never received any literature. Only a bill some time later. After contacting them they refuse to refund the 29.99 fee. This is nonsense seeing that I did not agree to any fee or even got to look at the program for which I am being billed. After three phone calls and explaining that I am being billed for something I do not have, the people for smartperks have still not offered to send the literature to me. They are definitly crooks. Stealing America's money.

Oh dear. I too agreed to look at a program. when the material did not arrive, i called the 800 number and canceled. that night the material was in my mailbox, and clearly not a program which would have interested me. Whew. but today, I received a Smart Perks package, which I never ordered.(I only agreed to a free trial program, and this onesays non-refundable, non-returnable.) In trying to find out who this company is, all I can find are consumer fraud sites like this one. I have called both of my credit card companies, and have nt yet been charged. The business which sponsored this charge (Newport News) isn't open on weekends, so I have sent them an email.
